Beta notice: VIV is currently in closed beta. These Terms will be updated at public launch. By using VIV during the beta period, you agree to these Terms as they stand today.

1. Who we are

VIV is a hormonal performance intelligence platform for women, designed to translate cycle data into personalised training, nutrition, and recovery guidance. VIV is currently operated as a trading name by its founder, pending formal legal incorporation within the European Union.

2. Who can use VIV

To use VIV you must:

  • Be 16 years of age or older

  • Have a natural menstrual cycle, or a cycle affected by hormonal contraception

  • Have received an invitation to the current closed beta, or have been accepted via our waitlist

  • Agree to these Terms and our Privacy Policy

VIV is not currently suitable for users who are pregnant, postpartum, or in menopause. This is a product scope decision, not a medical one. We plan to expand eligibility in future versions.

3. The service we provide

VIV provides personalised guidance for training, nutrition, and recovery based on your hormonal cycle. Our recommendations are informed by observational research on women's performance across the menstrual cycle.

Important: VIV is a performance and wellness tool not a medical device, clinical service, or health treatment. Nothing within the VIV app constitutes medical advice. You should not use VIV as a substitute for professional medical guidance. If you have health concerns, consult a qualified healthcare professional.

The recommendations VIV generates reflect patterns observed across users and research — individual responses will vary. We make no guarantee that any specific recommendation will produce a particular outcome.

4. Beta product — what this means for you

VIV is currently in a closed, invite-only beta. As a beta user you understand and accept that:

  • The app and its features are in active development and may change, be added to, or be removed without notice

  • You may encounter bugs, errors, or incomplete features

  • We may reach out to you for feedback — this is how we build a better product together

  • These Terms, the pricing structure, and the feature set will be updated before public launch

We consider our beta users co-builders of VIV. Your feedback is not just welcome — it is integral to what we are building.

5. Voluntary contributions during beta

VIV is currently free for all beta users. Some users choose to support VIV's development through a voluntary financial contribution of between €10 and €45.

Voluntary contributions:

  • Are entirely optional and have no effect on your access to the app or the quality of your recommendations

  • Are not purchases of a subscription or any specific feature

  • Are not refundable, as they are discretionary contributions to support an early-stage product

  • Do not create any additional contractual obligation between you and VIV

When VIV moves to public launch, a subscription model will be introduced. Beta users will be given advance notice of pricing and any transition terms.

6. Your account

You are responsible for maintaining the confidentiality of your account credentials. You must not share your account with others or allow others to access your account.

You agree to provide accurate information when creating your account and during onboarding. Inaccurate information - particularly cycle data - will result in less accurate recommendations.

You can delete your account at any time via Settings → Privacy → Delete my account.

7. How you may use VIV

You may use VIV for your own personal, non-commercial use. You may not:

  • Copy, modify, distribute, or reverse-engineer any part of the VIV app or its content

  • Use VIV to train a competing product or service

  • Attempt to access any part of VIV's infrastructure, data, or systems beyond your own account

  • Use VIV in any way that violates applicable law

8. Our content

The guidance, recommendations, content, and educational material within VIV are owned by VIV and protected by intellectual property law. You may not reproduce or distribute this content without our written permission.

9. Your content

Any data you enter into VIV - your cycle data, check-in responses, training logs - remains yours. By entering it, you grant VIV a limited licence to process it for the purpose of generating your recommendations, as described in our Privacy Policy.

If you have opted into our shared intelligence programme, you additionally grant VIV a licence to use a fully anonymised version of your data to improve our recommendation engine. This licence ends when you withdraw your consent or delete your account.

10. Availability and changes

We aim to keep VIV available but cannot guarantee uninterrupted access, particularly during the beta period. We may update, modify, or temporarily suspend the service without notice.

We reserve the right to change these Terms. When we make material changes, we will notify you in the app. Continued use of VIV after notification constitutes acceptance of the updated Terms.

11. Termination

We may suspend or terminate your access to VIV if you breach these Terms, or if we decide to discontinue the beta programme. We will give reasonable notice where possible.

You may stop using VIV at any time and delete your account via the app.

12. Limitation of liability

To the extent permitted by applicable law, VIV is not liable for:

  • Any indirect, incidental, or consequential loss arising from your use of the app

  • Loss of data (though we take reasonable measures to protect yours)

  • Any health outcome resulting from following VIV's recommendations

  • Interruptions to the service during the beta period

Nothing in these Terms limits our liability for fraud, personal injury caused by our negligence, or any other liability that cannot be excluded by law.

13. Governing law

These Terms are governed by the laws of Germany. Any disputes shall be subject to the jurisdiction of the courts of Berlin, Germany, unless mandatory consumer protection law in your country of residence provides otherwise.
